Contracts!

Without the use of contracts, a project disagreement can turn into a a nightmare for all parties involved. From arguments about deadlines, creative control, finance etc these things can be detrimental to a projects success and or completion.

When any number of parties decide to collaborate together, it is beneficial to all involved to set up a contract that highlights your sole responsibilities to the project. Below is a template that highlights a musical composers requirements contributing to a television program -

As you can see the requirements for the music producer in this contract are clear. Delivery dates and expected content are outlined and agreed upon by both parties.

Another important aspect of a contract is regarding to payment of services. This should be clearly defined and agreed upon immediately as money can sink a project. Below is an excerpt of a payment section of a music contract-

In the above example, the producer/artist have agreed to pay the producer 5% of the net profits of the song/project. Generally, producers are awarded 'points' which then determine exactly how much they will receive from the total/continual earnings of the product. Production costs i.e. studio time, mics, musician hire etc are also payed for by the company/artist who is hiring the producer and does not impact the agreed upon compensation for his/her services. Composers may also be entitled to an advance payment of an agreed upon sum, which, pending on the amount, can also impact or determine the percentage of royalties they are entitled to. More upfront can equal less on the back end; which could be a huuuge mistake.

Contracts are there to protect all involved but can also be the proverbial 'nail in the coffin' to those who enter blindly into agreements. It is probably best for you to seek legal advice if you do not know what you are reading or have not been involved in a contract setting before!!
